Terms of Service for KibiBot

Welcome to KibiBot (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of our website, services, applications, and features — including our web terminal available at kibi.bot, the KibiBot Agent API, the KibiBot Kibi LLM Gateway, and our social platform integrations (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Who We Are

KibiBot is an AI-powered platform that enables users and AI agents to deploy tokens on multiple blockchain networks (Base, BNB Chain, and Solana) through conversational interfaces (X/Twitter) and a web terminal. KibiBot integrates with Privy, a third-party wallet provider, to enable you to create and manage your own digital wallets and to initiate blockchain transactions directly from those wallets. KibiBot does not take custody of your digital assets and does not guarantee execution, pricing, accuracy, or timing of any transaction.

2. Acceptance of Terms

By using our Services:

  • You represent and warrant that you have read, understood, and agree to these Terms as well as any additional policies or guidelines incorporated herein by reference.
  • You must be at least 18 years old to use our Services. By registering, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
  • If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
  • To access certain features of our Services, you must create an account and connect via X (Twitter). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. Using Our Services

KibiBot provides you with interfaces to deploy tokens on blockchain networks, manage digital wallets through our integration with Privy, and interact with AI-powered tools. The Services are not a physical product or good. By using the Services, you acknowledge and agree that the Services are intangible software tools designed for informational and interactive purposes.

3.1 Non-Custodial Nature of Services

KibiBot is a non-custodial platform. This means:

  • Private Key Security: We do not have access to, store, or manage your private keys. Private keys are generated and managed by you via Privy, a third-party wallet provider.
  • Account Security: You are solely responsible for safeguarding your account information. Please notify us immediately if you suspect any unauthorized access or use of your account. We will not be liable for any loss resulting from your failure to protect your account information.
  • No Asset Custody: We do not take custody of your digital assets. All assets are held in wallets you control directly through Privy's infrastructure.
  • Direct Blockchain Interaction: Transactions (e.g., token deployments, transfers) are executed directly from your wallet without us acting as an intermediary. You authorize transactions, and they are broadcast to the blockchain through your wallet.

3.2 Token Creation

You are solely responsible for tokens deployed through the Services, including their name, symbol, description, and any associated content. KibiBot does not endorse, recommend, or guarantee any token created through the platform. You acknowledge that token creation involves interaction with third-party smart contracts and platforms (such as BaseMeme, Clanker, flap.sh, four.meme, and pump.fun) which are governed by their own terms and conditions.

3.3 Blockchain Transactions

  • Irreversibility: Transactions executed on the blockchain through our Services are final and irreversible. You must carefully verify all instructions before submitting them.
  • Risk Acknowledgment: You understand that blockchain technology carries inherent risks — including volatility, potential loss of funds, smart contract vulnerabilities, and network delays — and you agree that we are not responsible for any loss or damage arising from these risks.
  • Gas Sponsorship: KibiBot may sponsor gas fees for certain transactions at its discretion. This sponsorship may be modified, reduced, or discontinued at any time without notice.

4. API Keys and Agent API

4.1 API Key Security

API keys (“kb_” keys) are personal and confidential. You are responsible for all activity performed using your API keys. Do not share your API keys publicly or with untrusted parties. API keys are stored as irreversible cryptographic hashes — we cannot recover a lost key. If you believe your API key has been compromised, revoke it immediately through the KibiBot dashboard.

4.2 Rate Limits and Fair Use

API access is subject to rate limits (currently 1,000 requests per day per key). Excessive, abusive, or automated usage patterns that degrade the service for other users may result in temporary or permanent key revocation. Rate limits may be adjusted at our discretion.

4.3 Access Controls

You may optionally restrict your API key to specific IP addresses using the IP allowlist feature. Individual features (such as Kibi LLM Gateway access) may require explicit activation per key. You are responsible for configuring appropriate access controls for your use case.

5. Kibi LLM Gateway

5.1 Credit System

The KibiBot Kibi LLM Gateway provides access to AI language models through an API. Usage is metered and deducted from your credit balance. Credits are non-refundable once consumed. Kibi LLM Gateway access must be explicitly enabled on each API key.

5.2 Model Availability

Available models, pricing, and capabilities may change at any time. We do not guarantee the availability, accuracy, or suitability of any specific model for your use case.

5.3 Usage Responsibility

You are responsible for all content submitted to and generated by the Kibi LLM Gateway through your API keys. You agree not to use the Kibi LLM Gateway to generate content that is illegal, harmful, or violates the acceptable use policies of the underlying model providers.

6. Fee Earnings and Rewards

Tokens created through KibiBot may generate trading fee earnings for the token creator, subject to the fee structures of the underlying platforms. Fee rates, distribution schedules, and eligibility criteria are determined by the respective platforms and may change without notice. KibiBot does not guarantee any specific level of fee earnings. KibiBot may collect a platform fee from creator earnings.

7. Points and Referral Program

KibiBot may offer a points and referral reward system. Points have no monetary value and cannot be exchanged for cash or digital assets unless explicitly stated. The points program, including earning rates, redemption options, and program rules, may be modified or discontinued at any time.

8. Intellectual Property

All content, features, and functionality of the Services — including but not limited to text, graphics, logos, and software — are owned by us or our licensors and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Services without our prior written consent.

9. Prohibited Activities

You agree not to:

  • Use the Services for any illegal purpose or in violation of any applicable laws or regulations.
  • Create tokens that impersonate other projects, individuals, or organizations.
  • Engage in market manipulation, wash trading, or other fraudulent activities.
  • Attempt to gain unauthorized access to the Services or other users' accounts.
  • Use automated systems to abuse rate limits or circumvent access controls.
  • Interfere with or disrupt the integrity or performance of the Services.
  • Use the Kibi LLM Gateway to generate harmful, illegal, or deceptive content.
  • Reverse engineer, decompile, or disassemble any part of the Services.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU ACKNOWLEDGE THAT THE USE OF BLOCKCHAIN TECHNOLOGY AND DIGITAL ASSETS INVOLVES SIGNIFICANT FINANCIAL RISK. YOU SHOULD NOT USE ASSETS THAT ARE MATERIAL TO YOU OR BEYOND WHAT YOU ARE WILLING AND ABLE TO LOSE. YOU ASSUME FULL RESPONSIBILITY FOR ANY LOSSES AND ACKNOWLEDGE THAT YOU ARE PREPARED TO ACCEPT A TOTAL LOSS OF ALL FUNDS OR ASSETS USED WHILE INTERACTING WITH THE SERVICES.

12. Termination

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, including but not limited to violation of these Terms, suspected abuse, or as required by applicable law. Upon termination, your right to use the Services will immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to disclaimers, limitations of liability, and dispute resolution.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website with a new “Last Updated” date. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall be resolved through binding arbitration, except where prohibited by applicable law.
